Preiskel represents ARTICLE 19 and Germany’s Society for Civil Rights to the European Commission in their complaint against Apple abuses in its App Store

Preiskel & Co Competition team, led by Tim Cowen, represented ARTICLE 19 and Germany’s Society for Civil Rights to the European Commission in their complaint against Apple abuses on its App Store.

As reported by Reuters, the joint complaint made on the 22 October 2025 concerns abusive practices over the terms and conditions that allegedly breach landmark rules. Apple has been previously fined 500 million euros ($583 million) in April of the same year for violating the Digital Markets Act (DMA).

Apple was designated under the DMA as a gatekeeper for several core services. As such this company needs to comply with a number of obligations on an ongoing basis in the services, which includes the App Store.

Apple violated Articles 6(4) and 6(7) of the DMA by not guaranteeing interoperability for small and alternative businesses and by not providing more choice for users. Apple used the terms and conditions governing the App Store and the iOS operating system making it practically impossible for third party providers to offer their app through Apple’s products.
